Information on Connected Products under the EU Data Act

Many of our devices – e.g. smartphones, tablets, laptops, smartwatches, headphones and routers – are connected products within the meaning of the EU Data Act (Regulation (EU) 2023/2854).

We, Firstcom Trading GmbH (CarbonPhone), sell, among other things, connected products within the meaning of the EU Data Act. Please note that we act exclusively as a seller and have no influence on the type, scope or use of the data collected, nor are we responsible for the technical implementation, storage or use of this data. Responsibility for, and the further design of, data collection and use lies solely with the respective manufacturer of the product. Firstcom Trading GmbH is not a data holder within the meaning of the Data Act and does not process or use this data for its own purposes.

For refurbished devices, all data from previous owners is removed before sale by means of certified data erasure.

What data is generated?

Product-related data is generated when a connected product is used. Details of the type, format and estimated volume of product data that the connected product is capable of generating are provided by the respective manufacturer. The manufacturer can also provide information on whether the connected product is capable of generating data continuously and in real time and of storing data on the device or on a remote server (including, where applicable, the intended retention period), as well as on how the user can access, retrieve or, where relevant, erase the data, including the technical means to do so, and the applicable terms of use and quality of service.

Accessories without data functions

Pure accessories such as cases, screen protectors, chargers, cables or memory cards do not generate usage data and are not connected products within the meaning of the Data Act. This applies, among others, to products of the brands caseym, ESR, Gear4, Mobilize, PanzerGlass, QDOS, SanDisk, STRAX, Urban Armor Gear (UAG), XQISIT.
